Ross Richdale Plumbing – Terms of Trade 2025
1. QUOTATIONS
All quotations and/or offers from Ross Richdale Plumbing (the “Seller”) to the “Buyer” are issued subject to these Terms of Trade, or in accordance with the Construction Contracts Act 2002 where applicable.
Unless otherwise stated in writing, prices are valid for 30 days from the date shown on the quotation.
No verbal agreement, promise, or arrangement made by any employee or representative shall vary these terms unless confirmed in writing by the Seller.
2. PAYMENT TERMS
Payment for goods and/or services, plus GST, is due in full on or before the due date printed on the invoice.
Any prompt-payment discount offered will only apply if the account is settled within 10 days from delivery or installation (whichever occurs first).
Overdue balances may incur interest at 2% per month, calculated daily from the due date until payment is received in full.
The Buyer is liable for all collection and legal costs (including solicitor–client costs) incurred by the Seller in recovering outstanding amounts.
Any questions about an invoice must be raised within 7 days of the invoice date.
The Seller may request a completed credit application and a personal guarantee from company directors prior to commencing work.
A 1.99% processing fee applies to payments made by credit card.
3. RETURNS & CREDITS
Products ordered, manufactured, or customised specifically for the Buyer are non-returnable unless agreed to in writing by the Seller.
Standard stock items may be returned within 30 days in unused condition and in original packaging, and may incur a restocking fee of at least 15%.
4. RETENTION OF OWNERSHIP
Ownership of all goods supplied remains with the Seller until full payment is received.
The Seller may enter the Buyer’s premises (or any other location where the goods are held) to recover goods in the event of non-payment, and the Buyer indemnifies the Seller against any costs or claims arising from such entry.
The Buyer may on-sell the goods in the ordinary course of business, but proceeds must be held in trust for the Seller and clearly identifiable as such.
5. RISK & INSURANCE
Risk in goods passes to the Buyer upon delivery to the Buyer’s address, vehicle, or nominated delivery point, regardless of whether payment has been made.
It is the Buyer’s responsibility to insure the goods from the time of delivery.
6. PERMITS & APPROVALS
Unless specified otherwise in the quotation, the Buyer is responsible for obtaining any consents, permits, licences, or approvals required for the work.
Any costs or delays associated with obtaining such approvals are the Buyer’s responsibility.
7. WARRANTY
The Seller warrants goods manufactured by the Seller to be free from defects in materials or workmanship for 12 months from the date of delivery.
The warranty is subject to the Buyer notifying the Seller in writing of the defect within 14 days of discovery, and granting reasonable access for inspection and repair.
The warranty does not apply to:
Goods altered or repaired by anyone other than the Seller
Damage caused by misuse, neglect, corrosion, abnormal conditions, or poor maintenance
Fair wear and tear
For goods not manufactured but installed by the Seller, the Seller will, where possible, pass on the manufacturer’s warranty.
This warranty excludes any consequential or indirect loss.
8. PRIVACY & CREDIT INFORMATION
The Buyer authorises the Seller to seek and collect credit information from third parties as required to assess and manage the Buyer’s account.
The Buyer consents to the Seller sharing credit information with debt recovery agencies and credit reporting bodies in the event of non-payment.
The Buyer understands that a default may be recorded on their credit file.
9. PERSONAL PROPERTY SECURITIES ACT 1999 (PPSA)
The Buyer agrees these Terms create a security interest in all goods supplied until full payment is received.
The Seller may register a financing statement under the PPSA and the Buyer waives the right to receive a verification statement relating to such registration.
Ross Richdale Plumbing may update these Terms of Trade from time to time, with revised terms applying to all future work and supply.
